Nintendo has won a lawsuit against a streamer who pirated the game and streamed it ahead of its release date.
Pirate Jesse “EveryGameGuru” Keighin infamously wrote to Nintendo “bragging” that he had “a thousand burn channels” to stream and threatening to continue using them, saying he could “do this all day.” “You may run a business, but I run streets,” he wrote on social media at the time. He has now been ordered to pay $17,500 in restitution.
Last November, we learned Nintendo sues player for streaming pirated Nintendo games For example The Legend of Zelda: Echoes of Wisdom before the official release date. Nintendo filed a lawsuit against Keighin in a Colorado court, accusing him of not only live-streaming 10 Nintendo games before they were released, but also telling viewers how to obtain the games. The list includes The Legend of Zelda: Echo of Wisdom, Super Mario Party, and Mario & Luigi: Brotherhood.
According to the lawsuit, since 2022, Keighin obtained and live streamed leaked Nintendo games at least 50 times and provided viewers with links to Yuzu and Ryujinx emulators. Nintendo claims these actions amount to “trafficking” of illegal “circumvention devices” and insists they caused “millions of dollars” worth of damage through “lost video game sales.”
according to torrent maniacHowever, the court disagreed with issuing an injunction against the anonymous “third party” or ordering the “destruction” of the device Keighin used to circumvent Nintendo's pirated system, saying the request was “unclear” and “unreasonable” without knowing who those third parties were or what the circumvention device specifically was.
However, the injunction was granted against Keighin, preventing him from “infringing Nintendo's copyrighted works, including through streaming, and trafficking in Switch emulators, Nintendo's proprietary encryption keys, or other software or technology that circumvents Nintendo's technical protection measures.”
According to reports, the fund has not prepared a defense and has not raised any objections. The judgment is now final.
IGN reported earlier this month that Nintendo sues Reddit moderator for $4.5 million over alleged Switch piracyclaiming that this figure “is nowhere near sufficient to compensate Nintendo of America for the seriousness of the defendants' conduct.”
The conduct Nintendo is referring to is what it calls “DMCA anti-trafficking violations” by James “Archbox” Williams, a moderator of the Switch Pirates subreddit who has been accused of copying and distributing pirated Nintendo Switch games. Nintendo tracked down alleged Switch pirates last year using a combination of Reddit posts and repair orders.
